The Commission Has Become the Representative of OHIM

On July 15th, 2015, the Commission has officially become the Representative of EU Office for Harmonization in the Internal Market (OHIM). The status of the Commission as the Representative has been publicized on the official website of OHIM. From now on, the Commission can represent OHIM to provide the intellectual property service for Chinese enterprises to register their trademarks and designs in the market of EU.
OHIM is the official department of EU, whose task is to promote and manage Community Trademarks and Community Designs within EU. It carries out registration procedures for titles to EU industrial property and keeps public registers of these titles. It shares with the courts in EU Member States the task of pronouncing judgment on requests for invalidation of registered titles. The current president is Mr. AntónioCampinos. OHIM represents EU to have established the working relationship with the Chinese authorities of intellectual property and has been the major party at China-Europe Intellectual Property Dialogue since 2005.
Since December, 2014, the Commission has established the working relationship with OHIM in order to explore the new channels concerning the following works: to carry out the IP protection for EU in China, to provide the IP protection for Chinese enterprises in European market and to provide the certification service of registering the trademarks and designs of Chinese enterprises in EU. The related proposals have received the positive feedback from OHIM. On May 28, 2015, at the invitation of OHIM, Mr. ZHANG Yi headed the delegation to pay a visit to the Headquarters of OHIM and carried out the friendly business meeting with the high officials concerning the road map of cooperation. On June 19, Mr. ZHANG Yi invited Mr. Christophe Gimenez, OHIM IP Attaché in Beijing, First Counsellor to have the field investigation on EU-China Cultural Creativity Headquarters Base (the project of EUCNC) within Beijing Chang An No. 1 International Finance Art Center. Both parties had the in-depth discussion on the joint efforts of establishing the innovative service for EU IP certification.
In accordance with the regulations of OHIM, the Commission has set up the subsidiary company, EUCNC Holding S. L. in Alicante, Spain, which represents OHIM to provide the IP service of registering the trademarks and designs in EU for Chinese enterprises. With this service as the basis, the Commission has set up the Certification Center. The Certification Center is the professional institution that provides the one-stop service for Chinese and European enterprises to enter their counterpart’s market with the coverage of professional assessment, designing, consulting, training and financing. The Certification Center is contacting other functionary departments, the authoritative authentication institutions at EU Headquarters and its Member States in order to provide more professional services with a view to becoming the innovation-oriented comprehensive and authoritative certification center within three years and providing the all-rounded and unique service for Chinese and European enterprises.
